These Terms of Service (“Terms”) govern your access to and use of platepillows.com and your purchase of products from Plate Pillows. Throughout these Terms, “Plate Pillows,” “we,” “us,” and “our” refer to Plate Pillows LLC.

By visiting our website, placing an order, or otherwise using our services, you agree to these Terms. If you do not agree, please do not use our website or purchase our products.

Our store is hosted by Shopify Inc., which provides the ecommerce platform that allows us to sell our products and services to you.

1. Eligibility and acceptable use

You must be at least the age of majority in your state, province, or country of residence—or have permission from a parent or legal guardian—to use this website or make a purchase.

You may not use our website or products:

  • For unlawful, fraudulent, or unauthorized purposes;

  • To violate intellectual-property or other third-party rights;

2. Product information

We make reasonable efforts to display product descriptions, photographs, colors, measurements, materials, capacities, and other information accurately. However, colors may appear differently depending on your screen and lighting conditions, and measurements may vary slightly.

Many Plate Pillows products are handmade, hand-finished, or hand-painted. Natural and production-related variations—including slight differences in color, glaze, texture, shape, pattern placement, brushwork, bubbles, or dimensions—may occur. These variations are generally characteristics of the product and are not necessarily defects.

Product availability is not guaranteed. We may modify, discontinue, or limit the quantity of any product at any time.

You are responsible for reviewing all product-specific care and safety instructions before purchasing and using an item, including whether it is suitable for a dishwasher, microwave, oven, freezer, or food service. Product-specific instructions on the applicable product page or packaging control over general statements elsewhere on the website.

3. Orders and acceptance

Submitting an order does not guarantee acceptance. We may refuse or cancel an order for legitimate reasons, including:

  • Product unavailability;

  • Incorrect product or pricing information;

  • Suspected fraud or unauthorized payment;

  • Shipping restrictions;

  • Suspected resale or unauthorized commercial use; or

  • Orders that appear to circumvent purchase limits.

If we cancel an order after payment has been processed, we will refund the amount charged for the cancelled item or order to the original payment method.

Applicable taxes, shipping charges, duties, and other fees will be displayed or calculated when available. You agree to provide current, complete, and accurate payment and account information.

If a product is listed at an obviously incorrect price due to a typographical, technical, or system error, we may cancel the affected order and provide a refund.

5. Promotions and discount codes

Promotional offers and discount codes may be subject to separate terms, expiration dates, product exclusions, minimum-purchase requirements, and usage limits. Unless expressly stated otherwise:

  • Discounts cannot be combined;

  • Discounts cannot be applied retroactively;

  • Promotions have no cash value; and

  • Promotions may be modified or withdrawn before an eligible order is placed.

6. Shipping and delivery

Shipping estimates are estimates and are not guaranteed delivery dates unless expressly stated otherwise. Delivery may be affected by carrier delays, weather, customs, holidays, incorrect addresses, and circumstances outside our reasonable control.

We will ship orders within the time stated on our website or otherwise communicated to you. If we cannot ship within the promised time, we will provide any notice, cancellation option, or refund required by applicable law.

You are responsible for providing a complete and accurate delivery address. Additional shipping charges resulting from an incorrect address, refused delivery, or unclaimed package may be deducted from a refund or charged before reshipment, to the extent permitted by law.

International customers are responsible for applicable customs duties, import taxes, brokerage fees, and local charges unless checkout expressly states otherwise. Customs delays are outside our control.

7. Damaged, defective, or incorrect items

Because many of our products are ceramic or glass, please inspect your order promptly after delivery.

  • Your order number;

  • A description of the issue;

  • Clear photographs of the item;

  • Photographs of the shipping box and packaging; and

Please retain the item and all original packaging until we resolve the claim. Do not return an item without contacting us first.

Nothing in these Terms limits any rights you may have for products that are defective, misrepresented, or otherwise protected by applicable consumer law.

8. Returns, exchanges, and refunds

Returns, exchanges, cancellations, final-sale items, and refunds are governed by our Return and Refund Policy, which is incorporated into these Terms.

Original and return shipping charges are non-refundable unless stated otherwise in our Return and Refund Policy or required by law.

Refunds approved by us will generally be issued to the original payment method. Processing times may vary depending on your bank or payment provider.

9. Preorders and backorders

Products identified as preorders or backorders may have estimated shipping windows rather than fixed dates. Production and transportation timelines may change.

If a material delay occurs, we will provide notice and any cancellation or refund option required by applicable law. Purchasing an in-stock product together with a preorder may cause the entire order to ship together unless otherwise stated.

10. Personal and commercial use

Unless otherwise agreed in writing, products purchased through our retail website are intended for personal use and not for commercial resale.

Wholesale purchases, trade accounts, custom orders, restaurant orders, and other business-to-business transactions may be governed by separate written terms. If separate terms apply, those terms control to the extent of any conflict with these Terms.

11. Intellectual property

The Plate Pillows name, logos, product names, product designs, illustrations, photographs, videos, website layout, graphics, text, and other original content are owned by or licensed to Plate Pillows and are protected by applicable intellectual-property laws.

You may view and use the website for personal, non-commercial shopping purposes. You may not copy, reproduce, modify, distribute, sell, create derivative works from, or commercially use our content without prior written permission.

Nothing in these Terms transfers ownership of our intellectual property to you.

12. Reviews and submitted content

If you voluntarily submit a product review, photograph, comment, suggestion, or other content to us, you represent that:

  • You created the content or have permission to submit it;

  • The content does not infringe another person’s rights;

  • The content is not unlawful, deceptive, defamatory, or malicious; and

  • The information reflects your honest experience.

You grant Plate Pillows a non-exclusive, worldwide, royalty-free license to use, reproduce, display, and share content you intentionally submit to us for operating, improving, and promoting our business, subject to applicable law and our Privacy Policy.

We may remove submitted content that violates these Terms, but we are not required to publish or retain any submission.

13. Third-party services and links

Our website may contain links to or integrations with third-party websites, payment processors, social platforms, applications, and services. We do not control and are not responsible for their content, availability, security, products, or privacy practices.

Your use of third-party services may be governed by their own terms and policies.

15. Disclaimer of warranties

Products are subject to the express descriptions and warranties, if any, provided on their product pages or packaging. We do not exclude or limit warranties or consumer protections that cannot legally be excluded.

To the fullest extent permitted by law, Plate Pillows and its owners, employees, contractors, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from your use of the website or purchase or use of our products.

To the fullest extent permitted by law, our total liability relating to a product or order will not exceed the amount you paid for the product or order giving rise to the claim.

These limitations do not apply where prohibited by law and do not limit liability that cannot legally be excluded or restricted.

17. Indemnification

To the fullest extent permitted by law, you agree to indemnify and hold harmless Plate Pillows and its owners, employees, contractors, affiliates, and service providers from third-party claims, losses, liabilities, and reasonable expenses arising from your unlawful use of the website, your violation of these Terms, or your infringement of another person’s rights.

18. Governing law

These Terms are governed by the laws of the State of Washington, without regard to conflict-of-law principles. Any dispute not resolved informally will be brought in a court of competent jurisdiction in Washington, except where applicable consumer law gives you the right to bring a claim elsewhere.

Before filing a formal claim, you agree to contact us and make a good-faith effort to resolve the matter informally. This section does not prevent either party from seeking relief in small-claims court when eligible.

If product-specific terms conflict with these general Terms, the product-specific terms control for that product.
